Definitions & Interpretations The following terms and expressions shall have the following meanings: "Account" means one or more of your savings, current, credit card, loan, investment, fixed deposit or any other accounts with BSN and which may be accessed via MyBSN as may be determined by BSN from time to time. "Account Holder" means you, a customer of BSN and registered for use of MyBSN Internet Banking Services. "Account Terms" means the terms and conditions of the relevant Account(s) and/or Third Party Account(s) which may be accessed through MyBSN. "Affiliate" means any participating merchants or any other entity whos offering products, services, content and information on MyBSN website. Agreement means the terms and conditions of MyBSN Agreement herein, as may be varied from time to time. "Bank" means Bank Simpanan Nasional, an organisation incorporated under the Bank Simpanan Nasional Act 1974 and domiciled in Malaysia having its registered office at Wisma BSN, 117, Jalan Ampang, 50450 Kuala Lumpur and includes its subsidiaries and its successors in title and assigns, and where applicable, any of them. "Banking Services" means products and services offered by BSN and its Affiliates which are made accessible to you on MyBSN. "Bill" means the latest bills, renewal notice and/or payment demand issued by the Payee Corporation for the use or purchase of goods or services by you from the Payee Corporation. "Business Day" means any day from Monday to Friday on which BSN is open for business in Kuala Lumpur, Malaysia, but does not include any public holiday. "Instruction" means instruction given by yourself, electronically or otherwise, in respect of your Account(s) or any other transaction using MyBSN. "Internet" means the global network of computer networks that facilitate communication between Customers computer or any similar devices and BSNs servers, to perform transaction between you and BSN. "MyBSN Internet Banking Services" means the Banking Services and any other products and services, which you may access through the Internet, upon the correct input of your Username and Password. Loss means any and all losses, damages (financial and otherwise), injuries, embarrassments, costs, charges and/or expenses of whatsoever nature, including legal fees on a full indemnity basis. "Password" means a secret and unique string of characters chosen by you and known only to you and recorded in BSN's computer system, which must be keyed in by you for authentication of your Username and grant of access to the MyBSN. Payee Corporation means all products and service providers, or any business entity listed in MyBSN Bill payment screen for the purpose of enabling a Customer who is an Account holder to pay their bills via MyBSN. "Ringgit Malaysia" or "RM" means the lawful currency of Malaysia. "Terms and Conditions" means these Terms and Conditions governing the use of MyBSN and may include any amendments or deletion from time to time by BSN. "Third Party Account(s)" means your other account(s) maintained by BSN or other bank(s), Affiliates, Payee Corporations, or other third parties which you can make fund transfer either within BSN or outside BSN. "Transaction Record" means the confirmation of the receipt and/or execution of an Instruction initiated by you through the MyBSN as reflected in the Instruction Confirmation/Status View. "Username" means a unique name made up of a string of characters chosen by you which must be keyed in by you together with your Password in order to gain access to the myBSN.com.my Internet Banking Services. MyBSN means BSNs Internet Banking website which includes the unsecure and secure site. General You hereby agree that BSN's records of all information in respect of all transactions, instructions, communications, operations or transactions made or performed or effected by you or person purporting to be you through MyBSN and any record of transactions relating to the operation of any of our services shall be binding and conclusive on you for all purposes whatsoever and shall be conclusive evidence of the transaction and the your liability to BSN. You agree that BSN reserves absolute right to require you to maintain a minimum balance at any one time in your Account(s). Any failure to maintain such a minimum balance may, at BSN's discretion, result in a penalty being imposed on your account and may lead to a suspension or termination of MyBSN Internet Banking Services. You agree that BSN has the right to change any relevant cut-off time. Any Instructions transmitted by you after the relevant cut-off time on any day will be posted in the books and records of BSN on or for the next Business Day following the date of the Instruction. You shall not be entitled to use MyBSN, if there exists any restrictions whatsoever in your Account(s) either imposed by BSN or by any relevant authorities. Application To Subscribe To myBSN Internet Banking Services You may apply to MyBSN subject at all times to BSN's sole and absolute discretion whether to reject or accept your application. Should BSN reject your application, BSN is not obliged to provide any reason for such rejection or to respond to any request for information. Account Terms And Conditions You agree that the MyBSN are governed by these Terms and Conditions, and should be read together with the relevant Account Terms, services and/or products, rules and regulations of any related form of products. You agree to properly maintain and comply with the Terms & Conditions and any other applicable terms relating to your Account. Where there is any conflict between these Terms and Conditions and the relevant Account Terms, these Terms & Conditions shall prevail to the extent of such conflict. Equipment And Network Access In areas where it is beyond BSN's control, such as the security of the equipment used by you to access MyBSN, you agree that it is your obligation for installation, maintenance and operation of your computer terminal or other similar devices in a manner that does not present any opportunity for any third party to access to your personal information. You agree to purchase, install and maintain the software or applications used in accessing MyBSN at your own cost and expense. You are responsible for all the telecommunication charges and any other related charges incurred by the Network Service Provider and/or any other third parties. Access To myBSN Internet Banking Services You are required to register and follow the steps of creation of I-PIN via the Automated Teller Machine (ATM) or any other channels made available by BSN from time to time. At MyBSN, you are required to create a Username and Password, and to fill in certain information required for the first time login. Upon the successful authentication of your I-PIN and registration confirm by BSN, your access to MyBSN will be deemed to have been activated. After a successful authentication of your Username and password by BSN, all instructions or transactions issued thereafter shall be attributed to the Customer notwithstanding that such access, instruction or transaction may have been made by a third party whether authorised or unauthorised. Upon your successful registration, BSN reserves the right to determine the scope of functions, services and accounts that will be made available to you in MyBSN. BSN reserves the absolute right to deny any registration or to suspend any registered users without any prior notification or obliged to respond by any request for reason and information. You agree not to hold BSN liable for any consequences or losses that you may suffer as a result of your inability to access to MyBSN due to any reason. Once you have logged on to the Internet Banking Services, you must not leave the terminal or other devices from which you have accessed the Internet Banking Services at anytime or let anyone else use it until you have logged off. You are responsible for ensuring that you have logged off the service at the end of each session. Use Of myBSN Internet Banking Services Upon the successful login to MyBSN, you agree that BSN reserves absolute right to determine the scope of Internet Banking services as and when BSN deems add, suspend, limit, and amend or any other functions made available to you from time to time. Upon the activation of MyBSN login, you agree to access or transact accounts that legally belong to you. In the event that you are able to access any accounts not belonging to you, you agree that you shall be fully liable for any unauthorised transaction performed by you and you will indemnify BSN for all consequences arising from your authorised access or transactions. You shall ensure that your accounts have sufficient funds before performing any instructions or transactions via MyBSN. BSN has the right to reject any transaction due to the insufficient funds in your Account(s). In the event your Account(s) is overdrawn as a result of your Instructions being carried out by BSN or otherwise, you agree to repay the overdrawn amount with the interest or charges incurred by BSN. You agree that your Account(s) be debited by BSN immediately upon completion of each transaction carried out in MyBSN inclusive of any approved fees or charges. Authorisation You hereby authorise BSN to comply with all Instruction(s) given in respect of MyBSN including but not limited to authorise BSN to transfer, withdraw, deliver, dispose of or deal with any securities, documents or other properties. Instructions You hereby agree that any Instruction(s) received by BSN after the successful use of your Username and Password is an authorisation for BSN to rely and act upon your Instruction(s). In the event that you or someone purporting to be you, access to MyBSN and give any Instruction(s) to BSN, you agree that this Instruction(s) shall be deemed to have been issued by you notwithstanding that such Instruction(s) may have been issued by a third party whether authorised or unauthorised and BSN shall not liable for any loss which may incur. You agree that the Bank shall be entitled to act on any instructions transmitted after the successful use of your Username and Password to gain access to the Internet Banking Services by you or someone purporting to be you or by any third party whether authorised or unauthorised, and you agree that the Bank shall not be liable for any loss which you and/or any third party may incur by the Bank by doing so. BSN reserves the right, without having to assign any reasons, to refuse to act on any of your Instruction(s) given to BSN where your Instruction(s) are inconsistent with BSN's policy or any other reasons whosoever. You agree to review regularly the Transaction Record pertaining to any MyBSN transactions and BSN shall not be held liable for any mutilation, interruptions, omission, errors, delay or from its non-receipt or misinterpretation of your instructions. Should you have any reason to believe that an Instruction has not been accurately or completely received by BSN, you shall inform BSN by telephone immediately or in any other case no later than twenty four (24) hours after transmission of the relevant Instruction(s) by yourself. Any Instructions to BSN for cancellation, revocation, reversal or amendment or clarification of your earlier Instructions, can only be effected, if your request is received and effected before the earlier Instruction is executed. Availability Of Service MyBSN is intended to provide 24 hours service a day throughout the year. However, you acknowledge that MyBSN does not warrant availability at all times and may not be accessible at certain window of time due to the system maintenance or any other reasons beyond BSN's control. You agree that BSN have its absolute rights to withdraw any of the existing services or modify the existing services without any prior notice or reason from time to time and BSN shall not be liable for any loss which you may suffer as a result of BSN's action. Account Information You agree that all of your information provided to MyBSN are true and updated and BSN does not warrant the accuracy of any information pertaining to your Account(s) or transaction reported via MyBSN. You acknowledge that any information pertaining to your Account(s) may not be completely up to date and the account balance or transaction reported through MyBSN shall not for any purpose whatsoever is taken as conclusive of the status of your Account(s). BSN will issue you such statements of account which lists MyBSN transactions performed based on your Instruction as agreed in BSN's Account Terms. Bill Payment You agree that the list of Payee Corporation(s) offered by MyBSN are subject to change or may be amended by BSN from time to time without prior notice or any reasons thereof. BSN shall not liable for any loss or damage, which you may suffer as a direct or indirect result of BSN's actions. You agree that BSN only acts as a collection agent for the Payee Corporation and your Bill Payment may be subjected to the procedure, terms and conditions imposed by the Payee Corporation. You acknowledge that BSN's actions of debiting your account and remit the payment to the Payee Corporation are based on your Instruction given to BSN. You hereby agree that BSN shall not responsible for any rejection of payment by the Payee Corporation due to any reason whatsoever. In the event that your account has been debited for the bill payment but BSN has failed to remit the payments to the Payee Corporation on the due date which is beyond BSN's control, you shall be liable for any losses whatsoever for such failure of payment unless it was due to BSN's gross negligence or willful default. You are responsible to ensure and monitor the punctual payment of your bill and BSN shall not be responsible for any dispute between you and any Payee Corporation. Fund Transfer Transferring of funds from your Account to your own Account or to your third party Account maintained with BSN shall be effected immediately. BSN from time to time, reserves absolute rights to impose any limitations, terms and conditions for any Fund Transfer services as it deemed fit or in accordance to the requirement of relevant authorities. You agree that BSN shall not liable for any delay or rejects by other bank for transferring of funds via MyBSN to another bank which may subjected to the conditions of the receiving bank. Fees And Charges You agree and acknowledge that BSN reserve the sole right and discretion to levy a service charges for the same or any services from time to time in respect of the services provided and subject to BSN giving you prior notice of the same. You agree to remain liable for any fees or any charges imposed by BSN, service providers or any third party for connecting to MyBSN. Subject to the Account Terms of your Account(s), you acknowledge that BSN reserves the right to debit your relevant Account(s) for any Government charges, stamp duties or taxes payable as a result of the use of MyBSN services. Disclosure Of Customer's Information You agree that the disclosure of your information made available through Internet, BSN authorised personnel, its vendors, agents and service provider that directly or indirectly provide services or support to BSN which comply and permitted by laws and regulations. You hereby agree to authorise BSN to make use of your account information for all legitimate purpose unless you specifically inform BSN in writing of your refusal to disclose your account information for any specific purpose. You acknowledge that although BSN is committed to ensure that all information transmitted or received via MyBSN is secure and inaccessible by unauthorised third parties, BSN does not warrant the security of any information transmitted via MyBSN. Accordingly, you agree to accept all risk associated while using our services which information may be accessed by unauthorised third parties and agree not to hold BSN liable for any such unauthorised access or any loss or damage suffered as a result thereof. You agree that neither BSN nor any of its officers shall be liable for any loss or damage suffered as a result of disclosing or revealing of any information concerning your Account(s) with BSN.
